			<content:encoded><![CDATA[<p><img src="http://blog.legitiname.com/wp-content/uploads/2008/02/hammer.jpg" align="left" border="0" height="91" width="61" />Le conseil d’administration de l’<a href="http://www.legitiname.fr/glossaire/ICANN.html">ICANN</a> vient <a href="http://www.icann.org/minutes/prelim-report-23jan08.htm">d’accepter</a>, le 23 janvier dernier, la candidature de la Cour Arbitrale Tchèque (CAC) pour devenir un centre agréé <a href="http://www.legitiname.fr/glossaire/UDRP.html">UDRP</a> (<em>Uniform Domain Name Dispute Resolution Policy)</em>.  La CAC était déjà l’institution de règlement désignée pour la <a href="http://adr.eu/">résolution des litiges du .EU</a>.</p>
<p>Le règlement UDRP établi les principes directeurs qui permettent de résoudre les litiges relatifs à l&#8217;enregistrement abusif de noms de domaine.</p>

Selon la nature de la procédure de règlement des litiges, les institutions de règlement peuvent être agréées par l&#8217;ICANN (c&#8217;est le cas pour les procédures UDRP, ERDRP ou STOP) ou choisies par les registres. Les principes UDRP s’appliquent principalement aux domaines internationaux tels que .com, .net, .org, .info, .biz et .mobi.  Pour les <a href="http://www.legitiname.fr/glossaire/ccTLD.html">ccTLDs</a>, il n&#8217;est pas nécessaire que l&#8217;institution de règlement soit désignée par l&#8217;ICANN, le choix étant dévolu au <a href="http://www.legitiname.fr/glossaire/registre.html">registre</a> national. 50 extensions nationales (ccTLDs) ont désormais choisi le centre d’arbitrage et de médiation de l&#8217;OMPI comme prestataire de services pour la résolution de leurs litiges de noms de domaine (<a href="http://www.wipo.int/amc/fr/domains/cctld/index.html">voir liste des extensions</a>). Contre exemple :  Le DRS (<a href="http://www.legitiname.fr/article.php3?id_article=158">Dispute Resolution Service</a>) est le service de médiation et d’arbitrage de Nominet pour les litiges en .co.uk.</p>
<p>Les institutions de règlement <a href="http://www.icann.org/udrp/approved-providers.htm">agréées par l&#8217;ICANN</a> sont :<br />
·  le Centre d&#8217;Arbitrage et de médiation de l&#8217;OMPI (Cam-Ompi) ;<br />
·  le National Arbitration Forum (NAF) ;<br />
·  le CPR Institute for Dispute Resolution (CPR) ; et<br />
·  l&#8217;Asian Domain Name Dispute Resolution Center (ADNDRC)</p>

			<content:encoded><![CDATA[<p align="justify"><a href="http://blog.legitiname.com/wp-content/uploads/2008/01/ogco-google-1006.jpg"><img src="http://blog.legitiname.com/wp-content/uploads/2008/01/ogco-google-1006-thumb.jpg" alt="ogco_google_1006" align="left" border="0" height="120" width="159" /></a> Suite aux récentes <a href="http://blog.legitiname.com/2007/12/03/cybersquatters-taken-to-court/">prises de position de grandes marques comme Dell aux USA</a> contre la pratique de domain kiting de certains registrars, Google a annoncé le 25 janvier 2008 son intention de mettre en place une solution pour stopper les revenus pay-per-click (PPC°) pour les noms de domaine dont la date d&#8217;enregistrement a moins de 5 jours. Cette solution devrait être mise en place d&#8217;ici fin février.</p>
<p align="justify">Le but est de stopper les revenus PPC générés par la pratique du domain tasting et du domain kiting, qui exploitent la &#8220;période de grace&#8221; de 5 jours de réservation de noms de domaine sans paiment, pour tester le potentiel de trafic et générer du revenu publicitaire. Rappelons qu&#8217;initialement ces 5 jours étaient dédiés à la correction d&#8217;erreurs potentielles réalisées lors de l&#8217;enregistrement de noms de domaine.<span id="more-461"></span></p>
<p align="justify">Le domain kiting correspond au domain tasting mais fonctionne en boucle: les noms de domaine ne sont jamais payés et ne sont jamais remis sur le marché.</p>
<p align="justify">Voici un extrait du communiqué de Google envoyé par e-mail:</p>
<p align="justify">&#8220;We have long discouraged domain kiting as a practice&#8221;. &#8220;In order to more effectively deter it, we are launching a new domain kiting detection system. If we determine that a domain is being kited, we will not allow google ads to appear on the site. We believe that this policy will have a positive impact for users and domain purchasers across the web.&#8221;</p>
<p align="justify">Rappelons qu&#8217;en Octobre Yahoo a poursuivi en justice plusieurs registrars pour domain tasting, sur des noms de domaine cybersquattant ses marques ainsi que d&#8217;autres marques notoires protégées.</p>
<p align="justify">Reste à attendre la prise de position de l&#8217;ICANN sur ce phénomène qui ne peut plus être ignoré&#8230;et à espérer que des mesures seront prises pour assainir le marché des noms de domaine&#8230;</p>

According to ICM registry, the creation of .xxx would create big opportunities for registrars and promote responsible business practices on the web. Indeed, it would ensure more safety for children and families by the filtering the adult sites via .xxx.</p>
<p style="text-align: justify"><strong>Active opponents</strong></p>
<p style="text-align: justify">Despite the support of the adult-entertainment industry, the proposal of .xxx has faced various groups of opponents :</p>
<ul>
<li>intellectual property defendants, worried about <a href="http://www.legitiname.com/rubrique.php3?id_rubrique=8" target="blank">brand diversion</a> to porn contents,      </li>
<li>religious groups, fearing proliferation of adult sites and porn industry growth,     </li>
<li>own members of the adult-entertainment indutry, claiming that they would be enclosed and forced by the national authorities to adopt .xxx domain names. </li>
</ul>
<p style="text-align: justify"><strong>Controversial decision</strong></p>
<p style="text-align: justify">The decision was long, costly and subjective because of &quot;political interference in ICANN&quot; according to experts. The question of the dedicated extension for adult contents has emerged since March 2004, when <a href="http://www.icmregistry.com/" target="blank">ICM registry</a> and International Foundation For Online Responsibility (<a href="http://www.iffor.org/" target="blank">IFFOR</a>) suggested the creation of the .xxx additional TLD (<em>source: <a href="http://news.bbc.co.uk/2/hi/technology/5003920.stm" target="blank">BBC news</a></em>).</p>

<p style="text-align: justify">In fact, ICANN had received a large number of complaints about the <a href="http://www.legitiname.com/glossary/registrar.html">registrar</a> Registerfly, which was accredited in October 2004. The complainants were <a href="http://www.legitiname.com/glossary/registrant.html">domain name owners</a>, but also other registrars and employees of the own company.</p>
<p style="text-align: justify">Registerfly has been accused of domain name mishandling, causing harm for its customers. According to ICANN, the registrar had failed in:</p>
<ul>
<li>renewing customer domain names </li>
<li>providing authorization code and unlocking the domain names </li>
<li>maintaining up-to-date the domain name databases for the customers </li>
</ul>
<p style="text-align: justify">ICANN had also reported intentional alteration of <a href="http://www.legitiname.com/glossary/Whois.html">WHOIS</a> data, inexplicable disappearance of domain names from customer accounts (<a href="http://www.icann.org/correspondence/registerfly-notice-of-breach-21feb07.pdf" target="blank"><em>notice of breach</em></a>).</p>
<p style="text-align: justify"><strong>Towards a reform of the ICANN accreditation policy</strong></p>
<p style="text-align: justify">The registration accreditation policy will be discussed during the meeting organized by ICANN in Lisbon on 26-30 March. This question will probably be oriented in the direction of tighter eligibility conditions for accreditation. The meeting schedule will also include aslo intellectual property interests and evolution of the domain name secondary market.</p>

According to <a href="http://www.dotasia.org/">DotAsia Organisation Ltd</a>, .asia will first support Latin alphabet, then Asian languages (<a href="http://www.legitiname.com/glossary/IDN.html">IDNs</a>).</p>

<p style="text-align: justify">This corporation is made up of ICANN members that manage <a href="http://www.legitiname.com/glossary/ccTLD.html">ccTLD</a> <a href="http://www.legitiname.com/glossary/registry.html">registries</a> in the Asian area. Registration of dot asia will be divided into 2 steps :</p>
<ul>
<li>first, the Sunrise Period for trademark owners then, the general opening for entities present in Asia Pacific.      </li>
</ul>
<p style="text-align: justify">Beyond the &quot;.asia&quot; opening, it is a matter of competition with the leading TLDs (particularly .com) and of Internet growth in the area. At this day, there is about 400 million internet users in Asia (see details in the table below).</p>

En effet, cette&#160; industrie repr&#233;sente d&#233;j&#224; 12 milliards de USD et 10% du trafic du r&#233;seau mondial&#8230; L&#8217;ICANN qui devait prendre sa d&#233;cision mardi quant au lancement du .xxx &#224; reporter sa discussion sur le sujet au 15 septembre.
